What Brands Should Do Now
Extended Producer Responsibility: General
1. Check if you’re obligated.
2. Register with CAA.
3. Report annual packaging data to all states that require it by May 31st each calendar year.
4. Budget for fees and pay fees on schedule.
Extended Producer Responsibility: SB 54 Plastic Reduction
These steps should already have happened. If you haven’t taken these steps, do so as soon as possible.
1. Submit 2023 baseline via CAA's portal.
2. Submit 2025 Annual Supply Report and 2025 Annual Source Reduction Report.
3. Submit Individual Source Reduction Plan (ISR).
Once you've taken these steps, you should be actively implementing plastic-reduction efforts as outlined in your ISR.
SB 343 Truth in Labeling
On July 14, 2026, a federal judge blocked California’s Attorney General from enforcing SB 343. We expect the legislation to go be enforced at some point, at which point:
1. Audit recyclability claims across all packaging.
2. Remove recyclability symbols and language from items with a high non-compliance risk, such as poly mailers, bubble mailers, and thin film.
3. Treat “compostable” as a regulated claim.
4. Avoid on-pack claims of biodegradability.
Bans and Fees on Packaging Materials
1. Eliminate all PFAS and heavy metals from packaging, in accordance with PPWR and some US state and municipal legislation.
2. Strongly consider eliminating polystyrene (Styrofoam) entirely.
3. Be strategic about shopping bag choices if you operate retail locations. Choose between paper, plastic, or reusable based on state restrictions.
